Terms of Service

1. Acceptance of Terms

Welcome to ShortNow ("the App," "we," "us," or "our"). By downloading, accessing, or using ShortNow, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and ShortNow. We reserve the right to update these Terms at any time. Continued use of the App following any changes constitutes your acceptance of the revised Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShortNow regarding your use of the App and supersede all prior agreements and understandings.

 

2. Eligibility

• You must be at least 13 years of age to use ShortNow.
• If you are under 18 years of age, you must have the consent of a parent or legal guardian.
• By using the App, you represent and warrant that you meet the eligibility requirements stated above.
• ShortNow reserves the right to terminate accounts that do not meet eligibility requirements.

 

3. Account Registration

• You may be required to create an account to access certain features of the App.
• You agree to provide accurate, current, and complete information during registration.
• You are solely responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately at support@flixanime.com if you suspect any unauthorized access to your account.
• ShortNow is not liable for any loss or damage arising from your failure to safeguard your account.

 

4. Content on ShortNow

4.1 AI-Generated Content

• Some short dramas available on ShortNow are generated using artificial intelligence (AI) technologies.
• AI-generated content is provided for entertainment purposes only.
• AI-generated content should not be relied upon as professional, legal, medical, or factual advice.
• While we strive to ensure content quality and appropriateness, AI-generated content may occasionally contain inaccuracies, inconsistencies, or unintended outputs.
• ShortNow does not guarantee that AI-generated content reflects real events, real persons, or factual information.

4.2 Content Standards

We are committed to providing a safe and enjoyable experience. All content on ShortNow is reviewed and moderated to ensure it does not:

• Contain explicit sexual content involving minors
• Promote violence, hatred, or discrimination
• Violate applicable laws or regulations
• Infringe upon the rights of any third party

4.3 Content Availability

• Content availability may vary by region and jurisdiction.
• ShortNow reserves the right to modify, remove, or restrict access to any content at any time without prior notice.
• We do not guarantee the continuous availability of any specific title or series.

 

5. Purchases and Subscriptions

5.1 In-App Purchases

• ShortNow offers in-app purchases ("IAP") that allow you to unlock individual episodes, series, or other premium content.
• All in-app purchases are final and non-refundable, except as required by applicable law or as outlined in our refund policy.
• Prices are displayed in your local currency and may be subject to taxes and fees depending on your location.

5.2 Subscription Plans

• ShortNow offers subscription plans ("Subscription") that provide access to a library of content on a recurring billing basis.
• Subscription plans may include monthly, quarterly, or annual billing cycles.
• Your Subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
• You authorize ShortNow (or its payment processors) to charge your payment method on a recurring basis.

5.3 Cancellation

• You may cancel your Subscription at any time through your account settings or the respective app store (Apple App Store / Google Play Store).
• Cancellation will take effect at the end of the current billing period. You will retain access to subscription benefits until that date.
• Cancellation does not entitle you to a refund for any unused portion of the current billing period, except where required by law.

5.4 Price Changes

• ShortNow reserves the right to change subscription prices at any time.
• You will be notified of any price changes at least 30 days in advance.
• Continued use of the Subscription after the price change takes effect constitutes your acceptance of the new price.

5.5 Refund Policy

• All purchases made through the Apple App Store are subject to Apple's refund policy.
• All purchases made through Google Play Store are subject to Google's refund policy.

6. Intellectual Property

6.1 Ownership

• All content on ShortNow, including but not limited to AI-generated short dramas, scripts, audio, visual elements, graphics, logos, and software, is the exclusive property of ShortNow or its licensors.
• These materials are protected by applicable copyright, trademark, and intellectual property laws.

6.2 Limited License

• ShortNow grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App and its content for your personal, non-commercial entertainment purposes only.
• This license does not include the right to:
  • Download, copy, or reproduce any content
  • Distribute, publicly display, or broadcast any content
  • Modify, adapt, or create derivative works
  • Use any content for commercial purposes

6.3 Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the App
• Use automated tools (bots, scrapers, crawlers) to access or collect content
• Circumvent any digital rights management (DRM) or content protection measures
• Remove or alter any copyright, trademark, or proprietary notices

 

7. Prohibited Conduct

By using ShortNow, you agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's servers or networks
• Impersonate any person or entity
• Engage in any activity that could damage, disable, or impair the App
• Use the App to transmit spam, malware, or harmful code
• Exploit any bugs or vulnerabilities in the App

 

8. Privacy

Your use of ShortNow is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

9. Third-Party Services

• ShortNow may integrate with or link to third-party services, including payment processors and analytics providers.
• We are not responsible for the content, privacy practices, or terms of any third-party services.
• Your use of third-party services is governed by their respective terms and policies.

 

10. Disclaimers

• ShortNow is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
• ShortNow expressly disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• AI-generated content is for entertainment only and should not be relied upon as factual, professional, or advisory information.

 

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• ShortNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid to ShortNow in the 12 months preceding the claim.
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless ShortNow and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the App
• Your violation of these Terms
• Your violation of any applicable law or regulation

 

 

13. Termination

• ShortNow reserves the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice.
• Upon termination, your right to use the App will immediately cease.
• All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

 

14. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
• Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation.
• If a dispute cannot be resolved informally, it may be submitted to binding arbitration in accordance with applicable arbitration rules.
• You agree to waive any right to participate in a class action lawsuit against ShortNow.

 

15. Region-Specific Terms

15.1 European Economic Area (EEA) and United Kingdom

If you are located in the EEA or the UK, nothing in these Terms shall limit or exclude our liability for gross negligence, willful misconduct, or any consumer rights that cannot be waived under applicable law. You may have additional rights under EU consumer protection laws.

15.2 United States

If you are located in the United States, you agree that our service is provided without warranties except as required by law. Certain state laws may provide additional consumer rights.

15.3 Japan

If you are located in Japan, these Terms shall be interpreted in accordance with Japanese consumer protection laws, and any disclaimers or limitations shall apply only to the extent permitted under applicable law.

15.4 South Korea

If you are located in South Korea, these Terms shall comply with applicable Korean laws, including consumer protection and electronic commerce regulations, and any limitations of liability apply only as permitted by law.

15.5 International Use

You agree to comply with all local laws and regulations applicable to your use of our service in your jurisdiction.

 

16. Changes to These Terms

• We reserve the right to modify these Terms at any time.
• We will notify you of material changes via in-app notification or email.
• Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.

 

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
